COMMISSION TERMS OF SERVICE

By commissioning Mercury Illustration, you are agreeing to the terms of service below.
Please note that some exceptions these terms apply for Live2D commissions.

DEFINITIONS

Artist: The individual producing the commission ("Mercury").
Commissioner: The individual/Group requesting and purchasing the commission.
Commission: The form of service requested by the Commissioner, provided by Mercury, and the product(s) produced by the Artist for the Commissioner. (Used interchangeably with “Artwork”, “Project” herein.)

1. GENERAL - BE NICE

1.1 Please be clear and polite in all communications with the Artist.
1.2 Any behavioural or communication issues may result in the Commission request being declined.

2. PAYMENT - UPFRONT, NO PAYPAL

2.1 All payments are conducted via:
- Online banking transfer (aka. wire transfer), in GBP (£). Account details and instructions for payment will be provided by the Artist via digital invoice.
- Online checkout conducted via third-party platform Stripe. A URL will be shared by the Artist for a one-time payment. No Stripe account is necessary. The Artist does not have access to any card information entered via Stripe.
2.2 It is the Commissioner's responsibility to be aware of currency conversion rates and any additional transfer fees where applicable.
2.3 All Commissions must be paid in full upfront, unless otherwise agreed upon.
2.4 All payment must be due by the date provided on the invoice, unless otherwise agreed upon. Late payments or failure to communicate delays will result in the Commission being cancelled, and the Artist may refuse future commissions from the Commissioner.
2.5 The Commission will only be started after payment is received.

3. PROCESS - HOW THINGS WORK

3.1 Consultation
3.1.1 Requests will only be considered if received either via Twitter Direct Messages, email, or Discord.
3.1.2 Communications between the Commissioner and the Arist will be known as the “Consultation”. Most consultations will take the form of a two-way discussion to explore what would work best. Please ensure that the request the Commissioner would like to commission is provided in as much detail as possible, providing references where appropriate. The Artist will make every effort to respond in a timely manner, and expects the same from the Commissioner.
3.1.3 In general, the Artist does not accept deadlines. If you would like to request a deadline for delivery, please specify this as early on as possible and the Artist will strive to accommodate the request where possible. Orders requiring a short time frame may involve additional costs to be agreed upon at the outset of the Commission.
3.1.4 By processing payment, the Commissioner has agreed to the terms of service and any other details discussed and agreed in the consultation.3.2 Feedback and revisions
3.2.1 The first update will be an initial sketch, and subsequent feedback opportunities will be subject to discussion between the Artist and Commissioner.
3.2.2 It is the Commissioner’s responsibility to express any changes they would like at each feedback stage. Any changes made outside of the three stages will delay the completion of the Commission. Multiple instances of backtracking may incur additional fees.3.3 Completion
3.3.1 Completed projects will be sent to Commissioners via email, using the email address provided by the Commissioner in the invoice details, with a WeTransfer download link for the full-resolution file(s).

4. COPYRIGHT AND USAGE POLICY

4.1 The Artist holds all rights to finished Commissions, in accordance with United Kingdom (UK) copyright laws.
4.2 The Artist reserves the right to post Commissions in public spaces (e.g. as part of the Artist's portfolio, on social media), unless requested otherwise by Commissioners and agreed during Consultation.
4.3 Commissions are for personal use only, unless otherwise discussed and agreed upon during Consultation.
4.4 Commissioners may repost pieces with credit to the Artist.
4.5 Commissioners must not alter Artwork (including removal of watermarks) without prior discussion with and permission from the Artist.
4.6 Commissioners must not take credit for creation of the Artwork.
4.7 Commissioners must not use or redistribute or reproduce Artwork for commercial purposes (utilising in such a way that results in financial profit or remuneration), unless otherwise agreed upon.
4.8 The use of Artwork for any blockchain-related activities, including but not limited to minting non-fungible tokens (NFTs), is strictly prohibited and will result in legal action.
4.8 The use of Artwork for any AI image-generation, including being used to train AI image generators, is strictly prohibited.

5. CANCELLATIONS AND REFUNDS

5.1 The Artist reserves the right to refuse new Commissions at any time.
5.2 The Artist reserves the right to cancel Commissions for any reason prior to the receipt of payment.
5.3 The Artist reserves the right to cancel Commissions without refund if the Commissioner does not respond to a request for information or feedback within 7 days of the request having been sent.
5.4 Commissioners may request a cancellation and refund if the Project has not yet been started by the Artist.

6. PRIVACY

6.1 If references are required,the Artist will not share the ideas or images provided without
the Commissioner's consent.
6.2 All personal information, including those used for payment, will never be shared to
other parties by the Artist unless for legal purposes.
6.3 All personal information, including those used for payment, may not be shared to
other parties by the Commissioner.
6.4 Unless specified at the time of commissioning, the Artist reserves the right to share the drawing process via social media posts, video or live-streamed content.Clauses with the condition, “unless otherwise agreed upon”, must be confirmed with the Artist in writing. Any ambiguities as to the status of an agreed term or specification will be interpreted in favour of the Artist’s understanding.
